Terms of Service

1. Agreement to Terms

These terms govern your use of Memory, a service provided by Configure AI, Inc. ("Configure", "we", "us"). Memory provides persistent identity profiles that work across AI agents in the Configure network.

By verifying your phone number or using the Memory service in any way, you agree to be bound by these terms. If you do not agree to these terms, do not use the service.

2. The Memory Service

Memory by Configure provides persistent identity profiles for use across AI agents. Your profile includes identity information, preferences, memories, and data from connected tools such as Gmail, Google Calendar, Google Drive, and Notion.

The service is designed to make AI agents more personalized and context-aware by maintaining a continuous record of who you are and what you prefer. Your profile enriches automatically as you interact with any AI agent in the Configure network.

3. Account and Identity

Your account is identified by your verified phone number. One phone number corresponds to one identity across all applications using Configure.

You are responsible for maintaining access to your phone number. If you lose access, you may lose the ability to authenticate and manage your profile.

You must provide accurate information when using the service. You may not impersonate another person or create an account on behalf of someone else without their authorization.

4. Profile Portability

A core feature of Memory is that your profile is portable across AI agents. By using Memory, you consent to your profile being accessible to any application that integrates the Configure SDK, when you authenticate with that application.

By using Memory, you acknowledge that your profile may contain personally identifiable information (PII), including but not limited to your name, email address, occupation, and other details you provide or that are extracted from your conversations and connected tools. You understand and accept that when you authenticate with a developer's application, that developer may access your full profile, including any PII it contains.

Developers who access your profile through the Configure SDK are bound by the Configure Developer Terms, which prohibit selling, licensing, or transferring your data to any third party outside the Configure network. Configure enforces the Developer Terms but cannot guarantee that every developer will comply.

Granular controls over profile visibility are planned for a future release. Until then, your full profile is available to any application you authenticate with through Configure.

5. Connected Tools

You may connect third-party services (Gmail, Google Calendar, Google Drive, Notion) to enrich your profile. By connecting a tool, you authorize Configure to access the data described in our Privacy Policy.

You can disconnect any tool at any time through the app settings. Disconnecting a tool removes the associated data from your profile.

Configure is not responsible for the availability, accuracy, or completeness of data from third-party services. Your use of connected tools is also subject to the terms and policies of those third-party providers.

6. AI Processing and Memory Extraction

Conversations between you and AI agents using Configure may be processed by AI models to extract facts, preferences, and context. This extracted information is stored in your profile to improve personalization across agents.

AI-extracted data may be inaccurate, incomplete, or may inadvertently capture sensitive information from your conversations. You are responsible for reviewing and managing your profile content.

Currently, only extracted data is retained. Raw conversation content is not stored by Configure.

You can view, edit, and delete your memories at any time through the app settings. Deleting a memory removes it from your profile and from future agent interactions.

7. Data Ownership

You retain ownership of your personal data. By using Memory, you grant Configure a limited, non-exclusive, worldwide license to process, store, and display your data as necessary to provide the service.

This license terminates when you delete your data or account. Upon deletion, Configure will remove your data in accordance with the timelines described in Section 10.

8. Assumption of Risk

You acknowledge that the Memory service is designed to make your profile portable across AI agents. This portability inherently involves sharing your data, which may include PII, with third-party developers who integrate the Configure SDK. You voluntarily assume all risks associated with this data sharing, including the risk that a developer may use your data in ways that violate the Developer Terms.

Configure will enforce the Developer Terms against developers who violate them, but does not guarantee compliance by all developers and is not liable for the actions of third-party developers.

You can delete your account and all associated data at any time through the app settings.

Configure may suspend or terminate your account if you violate these terms, with or without notice depending on the severity of the violation.

Upon termination, your data will be soft-deleted immediately and permanently purged from our systems within 30 days. During the soft-deletion period, your data is inaccessible but may be recoverable by contacting support.

11. Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. Configure disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Configure does not guarantee the accuracy, completeness, or reliability of any profile data or AI-generated content. AI models may produce inaccurate extractions or summaries.

Configure is not responsible for how developers use your profile data, beyond enforcing the Developer Terms.

Configure is not liable for any personally identifiable information (PII) included in user profiles, whether provided directly by you, extracted by AI processing, or derived from connected tools. Configure is not liable for any disclosure, exposure, or access to PII by developers who access profiles through the Configure API. To the maximum extent permitted by law, Configure is not liable for any unauthorized disclosure, breach, or leakage of PII.

Configure does not guarantee developer compliance with the Developer Terms and is not responsible for developer misconduct. You are solely responsible for the information you provide to the service and for reviewing and managing your profile content.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Configure shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or damages arising from your use of or inability to use the service.

Configure's total aggregate liability for all claims arising out of or related to these terms or the service shall not exceed the amount you paid to Configure in the 12 months preceding the claim, or one hundred dollars ($100), whichever is greater.

Without limiting the foregoing, Configure shall have no liability whatsoever for any claims arising from the inclusion of personally identifiable information in user profiles or from the access to such information by developers through the Configure platform.

13. Force Majeure

Configure is not liable for delays or failures in performance resulting from causes beyond its reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, government actions, power failures, internet disruptions, or third-party service outages.

14. Modifications

We may modify these terms at any time. We will provide at least 30 days' notice of material changes via the service, email, or our website.

Your continued use of Memory after changes take effect constitutes your acceptance of the modified terms. If you do not agree to the modified terms, you should discontinue use of the service.

15. Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these terms or the service shall be resolved by binding arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures. The arbitration shall be conducted in English, in the State of Delaware or remotely at the election of the arbitrator.

You agree to resolve disputes with Configure on an individual basis only. You waive any right to participate in a class action, collective action, or representative proceeding against Configure.

Notwithstanding the foregoing, either party may bring individual claims in small claims court if the claims qualify.

You may opt out of this arbitration provision by sending written notice to legal@configure.dev within 30 days of your first use of the service. If you opt out, disputes will be governed by Section 16.

16. Governing Law

These terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles.

For disputes not subject to arbitration under Section 15, any claims shall be resolved exclusively in the state or federal courts located in the State of Delaware. You consent to the personal jurisdiction of such courts.
